Judge dismisses last-ditch attempt to block Colorado graduated income tax ballot measure
Denver District Judge Heidi L. Kutcher dismissed a lawsuit by conservative activist Michael A. Hancock seeking to invalidate Amendment 87, the graduated income tax measure already on Colorado ballots. A judge in Denver has dismissed a last-minute attempt by conservative opponents of a graduated income tax proposal to invalidate the measure on ballots already in Colorado voters. The court ruled that the issue of paperwork issues with some of the entities that circulated petitions for Amendment 87, which would raise income taxes on the top 3% of Colorado earners and slightly cut them for everyone else, does not outweigh Coloradans' "fundamental right" to participate in the initiative process as enshrined in the state constitution. The lawsuit was initially based on allegations that 69 of the measure’s petition circulators lacked a training certificate required by the secretary of state’s rules, but after the secretary’S office provided updated information showing that 66 of these circulators had received training, the plaintiff argued the signatures should still be invalidated. Judge Heidi L. Kutcher ruled that invalidating signatures would violate the supremacy of the constitutional provision for initiatives.
